Final pricing is subject to change if actual site conditions, scope, or required materials differ from what was initially described or assumed. Gus’s Solar will notify the customer of any material price adjustment before proceeding with the work. Proceeding after that notification constitutes acceptance of the revised price.
Governing law
These terms are governed by the laws of the State of CA, without regard to conflict-of-law principles. Any dispute arising from these terms or from services provided by Gus’s Solar shall be resolved exclusively in the appropriate state or federal courts located in CA. Users consent to personal jurisdiction in those courts.
Service area and availability
Gus’s Solar offers home services in San Jose, CA and the surrounding area. All services are subject to scheduling availability and a professional assessment of the job. Some requests are carried out by vetted independent contractors or trade professionals coordinated through Gus’s Solar; in those cases, Gus’s Solar acts as the arranging party. Availability and scope of work remain subject to the professional judgment of whoever performs the job.
Limitation of liability
To the fullest extent permitted by applicable law, Gus’s Solar’s total liability arising out of or related to any service or use of gussolarco.com is limited to the amount the customer paid for the specific service at issue. Gus’s Solar is not liable for any indirect, incidental, consequential, or punitive damages, including loss of use, loss of data, or loss of revenue, regardless of the legal theory under which such damages are claimed.
